Mediation with Gary Fields

Finding the Right Mediator
Not every mediator is right for every case. The best mediators are those who have actually been on the firing line on both sides and appreciate all aspects of the issues at hand. If the parties want a judge or jury to call "balls and strikes," they could continue with litigation. A mediator should assist in bringing the parties together to avoid litigation.

Gary Fields is both an AV rated practicing attorney and a private mediator, skilled at bringing factions together. With 37 years of business and legal experience handling a wide spectrum of cases, Gary helps parties evaluate the different perspectives of their case, having successfully handled similar cases during his many years of practice. A highly effective mediator, Gary is able to provide creative suggestions that meet all parties' requirements, while offering solutions when others give up. Gary does what it takes to accommodate the parties, and at the same time, assists them in resolving the case. It is not uncommon that he will tell parties that nobody can force them to settle, but by settling, they take the uncertainty out of litigation and gain control over their own destiny. When disputes become emotional, as they frequently do, Gary is effective in defusing the emotions and getting the parties back to trying to resolve the dispute. If deemed necessary, Gary will use the tools of a therapist or clergy or other professional in providing a forum for the venting of frustrations. Sometimes individuals must go through a cathartic experience before they can settle. Gary will ask people to address the weaknesses and vulnerabilities in their case. He will help the parties evaluate the different perspectives to their case and when asked how a judge or a jury may view certain motions or evidence, Gary can answer those questions based upon his experience.

"When Winning Feels A Lot Like Losing"
How many times have you been involved in a dispute that has resulted in a binding arbitration or jury trial where nobody was a winner? A skilled mediator can save a considerable amount of time and money by assisting in the resolution of a dispute. Cases often become "upside down" due to the expenditure of legal and expert fees, and yet they must proceed to trial, a trial that will also consume a significant amount of your client's time. Week after week, the Daily Journal reviews cases where it is obvious that the prevailing party did not really win the case due to the expenditure of legal and expert fees. Gary will take the time and exert the energy so all sides to a mediation feel that they have won by avoiding a trial.
